Generally speaking, the documents for a complete living trust may include the following legal documents:
- Living trust: This is the most important main document. A living trust designates a trustee to manage assets for the beneficiary, while the grantor is still alive.
- Pour-over will: It is used to transfer assets not already held in your trust before the person dies into the living trust after death.
- Advanced Medical Directive: A document authorizing a health care agent to make financial decisions on behalf of the individual when they are incapacitated.
- Financial Power of Attorney (durable power of attorney): A document authorizing an agent to make financial decisions on behalf of the individual when they are incapacitated.
- HIPAA Release Authorization Letter (Health Insurance Portability and Accountability Act Release): This document authorizes third parties, including parents, family members, friends, etc. to obtain personal health and medical information from medical institutions.
